GOVERNMENT OF PAKISTAN MINISTRY OF COMMERCE NOTIFICATION EXPORT POLICY ORDER,1999 Islamabad,the 28th July,1999. S.R.O.880(I)/99:- In exercise of the powers conferred by sub-section (1) of section 3 of the Imports and exports (Control) Act,1950 (XXIX of 1950), and in supersession of and in supersession the Export Policy Order,1998, the Federal Government is pleased to make the following Order namely:- 1. Short title and commencement:- (1) This Order may be called the Export Policy Order,1999. (2) It shall come into force at once. 2. Export of goods:- Export of all goods shall be allowed from Pakistan except - (A) goods specified in Schedule I, and (B) goods of the description specified in Schedules II and III, but allowed otherwise in accordance with the conditions and restrictions specified in the said Schedules. (C) The following goods or categories of goods shall be allowed export excluding those mentioned in schedules I, II and III. These may, however, be allowed as per the conditions and exceptions referred in these schedules or elsewhere in the Policy;- (a) any goods constituting the stores or equipment of any outgoing vessel or conveyance or the bona fide accompanied baggage of the crew or of the passengers in such vessel or conveyance; (b) any goods trans-shipped at a port in Pakistan after having been manifested for such trans-shipment at the time of despatch from a port outside Pakistan; (c) any goods consigned under a procedure prescribed for regulating transit traffic; (d) any goods except artemesia seeds, poppy seedsand fissionable materials forming contents of a bona fide sample: (e) any goods exported under a procedure specified for regulating trade between border areas of Pakistan and those of the adjacent territories; (f) Any stores or equipment when sold abroad on Government to Government basis and exported under an export authorization issued by the Director General of Defense Purchase or by a Director of the Directorate General of Defence Purchase in the Ministry of Defense or by any other officer authorized by the Ministry of Defense in this behalf; (g) bona fide samples or articles exported as such by an exporter in Pakistan provided that - (i) the f.o.b. value of sample doesn’t exceed US $ 2000 or equivalent per firm per annum; (ii) the samples are supplied free charge;

(iii) the consignor is registered exporter under the Registration (Importers and Exporters)Order, 1993,or has been exempted from registration thereunder; and (iv) all gift parcels of the valuenot exceeding five hundred rupees each: Provided that leather garment manufacturers shall be entitled to export fifty samples per annum, irrespective of monetary value: Provided further that the monetary and quantitative ceilings shall not be applicable if the samples are exported in a mutilated form; and (h) Export of relief goods to any part of the world by the Cabinet Division (Relief Cell), Government of Pakistan. (D) Export of counterfeit products shall not be allowed and shall be treated as contravention of Imports and Exports (Control) Act, 1950(XXIX of 1950), action shall be taken against such exporters by customs authorities, on receipt of comp[plaint through Export Promotion Bureau from the holders of the trade mark, franchise or licensee. Penal action shall also be taken for lodging unfounded complaints. 3. Procedure for export registration or renewal, etc. All exporters, other than organization in public sector, when applying for export registration or renewal of existing export registration shall, among other things, produce a certificate of membership of any of the trade organizations licensed by the Federal Government under the Trade Organizations Ordinance,1969(XLV of 1961). 4. Special dispensation.- In cases where certain exports are necessitated but are not covered by the provisions of this Order, such exports shall be allowed by special dispensation of the relevant provisions of this Order in consultation with concerned Ministries or with the approval of Economic Co-ordination Committee of the Cabinet, if considered necessary. Provided that, in circumstances, where certain restrictive provisions, contradictions and time-limit laid down under this Order are required to be removed in order to redress the problems of the Industry and exporters in the public interest, Ministry of Commerce will remove the same without consulting any other Ministry. 5. Validity of export authorization.- All export authorizations, unless extended, shall be valid for one year or as specified therein. SCHEDULE I S.NO. National Council for Conservation of Protected birds(Live or dead),meat,horns,bones, Wildlife(NCCW) as Management hides and skins untanned/tanned, finished leather Authority of Convention of International or garments made thereof; products and materials Trade in Endangered Species of Wild related to wild life their derivatives; stuffed/ Fauna and Flora(CITES) in Pakistan unstuffed, mounted hunting trophies; and is authorized to make exemptions for the Preserved specimens of wild animals. Following purposes, namely:- (i) Research; and (i) trophies from community managed conservation areas. II. Export of commercially bred sweet water turtles on production of NOC from NCCW. 5. Charcoal and firewood. - 6. Wood and Timber. - 7. Fissionable material - 8. Anti Personnel Landmines(APLS) - 9. Antiquities. - 9. Edible oil. Export of all edible oils in bottles or other consumer packs provided there is value-addition of 15% for edible uses in packs upto 5 litres and 50% value addition for non-edible uses in packs upto ½ litre. 10. Poppy seeds. 11. Chemicals as per details in Appendix “A” to this Order) Export to States or countries which have ratified the Chemical Weapons Convention. SCHEDULE II COMMODITIES WHOSE EXPORT IS ALLOWED THROUGH PUBLIC SECTOR AGENCIES ONLY . S.NO. Finished lubricants in blended form subject to production of No Objection Certificate from the Ministry of Petroleum and natural Resources. (i) Surplus lube base oil, petrochemicals, slack wax, Asphalt (bitumen) and naphtha subject to production of No Objection Certificate(NOC) from the Directorate General of Oil, Ministry of Petroleum and Natural Resources.

SCHELE III COMMODITIES SUBJECT TO QUALITY CONTROL UNDER VARIOUS RULES MADE UNDER THE AGRICULTURAL PRODUCE (GRADING AND MARKING) ACT 1937 (I OF 1937) Export of wool, animal hair,lamb skins of grades I to V, casings, egges, dry fish and shell fish, fish meal, bones, either crushed in powdered form, citrus fruits, lime and lemon, chillies, turmeric, ginger, garlic and onion, potatoes, radish, bringal, peas, asparagus, brussels sprouts, pumpkin, cauliflower’s tomato, cucumber(kheera), cucmber(kakri), carrot, fresh beans, artickokes, celery, turnip, green chillies, lady finger, guava, molasses, dates, banana, mangoes, oilseeds, oil cakes, including solvent extracted meals is subject to quality control in accordance with the relevant rules framed under the Agricultural Produce (Grading and marking) Act,1937 (I of 1937). 3. However, quality control restrictions on export of fruit and vegetables will not be applicable on exports of fruit and vegetables will not be applicable on exports to border countries. Note:- Other quality control requirements are stipulated in chapter 17 of Import and Export Procedure, 1998. 3. Engineering electric and other goods.- The export of following goods shall be allowed subject to the condition that the goods bear the Pakistan standard mark as specified in the Pakistan Standards and Quality Control Authority Act,1996 (VI of 1996):- (j) Engineering and electrical goods: Wet batteries, dry cell batteries, induction motors, electric ceiling roses, electric bulbs(Lamps), electric socket(outlets and adapters) for two and three pin plugs, two pin and three in plugs, PVC insulated electric cables, flexible cords, excluding armoured cables, electric irons, electric switches, electric boiling plates, immersion heaters, diesel engines, fluorescent tubes, general purpose lathe machines, shaping machines, pillar drills, capstain and turrent lathes and codial, drilling machines, bicycles and its parts,sewing machines, kettles for domestic use, ballast for fluorescent mapls, electric toasters, mild steel oil, pressure utility stoves, oil pressure stoves, brass type and non- pressure oil stoves. (ii) Other goods: Portland cement, sulphate resisting cement, asbestos cement corrugated sheets for roofing and colding, asbestos cement flat sheets, biscuits, soap (toilet and lanudry, carbolic flakes), safety razor baldes. 4. Manufacturers of the goods mentioned in paragraph 3 shall be exempt from the requirements of Pakistan Standard marks as specified in the Pakistan Standards and Quality control Authority Act,1996(VI of 1996) if they are are ISO-9000 or 14000 Series certified.
