GOVERNMENT OF PAKISTAN MINISTRY OF FINANCE, ECONOMIC AFFAIRS, STATISTICS & REVENUE (REVENUE DIVISION) *** Islamabad, the 30th April, 2008. NOTIFICATION (CUSTOMS) S.R.O. 412 (I)/2008.- In exercise of the powers conferred by section 19 of the Customs Act, 1969 (IV of 1969), the Federal Government is pleased to direct that the cooling towers, heat recovery steam generators and feed water pumps if imported by the New Independent Power Producers (IPPs), as specified below, shall be exempt from so much of the customs-duty as is in excess of 5% ad valorem leviable under the First Schedule to the Customs Act, 1969 (IV of 1969):- 1. M/s AttockGen Power Project. 2. M/s Orient Power Project. 3. M/s Atlas Power Project. 4. M/s Muridke (Sapphire) Power Project. 5. M/s Fauji Mari Power Project. 6. M/s Sahiwal (Saif) Power Project. 7. M/s Nishat Chunian Power Project. 8. M/s Nishat Power Project. 9. M/s Bhikki (Halmore) Project. 10. M/s Engro Power Project. 11. M/s Star Power Project. 2. This exemption shall be on one time basis subject to the following conditions, namely:- (i) the exemption shall extend to those of the specified IPPs who achieve Financial Close by the 30th April, 2008; (ii) the importers shall submit an undertaking to the Collector of Customs to the effect that the machinery and equipment shall be installed in their unit and shall not be utilized anywhere else; and (iii) in case of non-observance of the above conditions, the importer shall be liable to penal action under the relevant provisions of the Customs Act, 1969.
