Functions, Jurisdiction and Powers of NNDA to Exercise powers under the Customs Act, 1969

GOVERNMENT OF PAKISTAN (REVENUE DIVISION) FEDERAL BOARD OF REVENUE ***** NOTIFICATION Islamabad, the 17th November, 2022. S.R.0.7.1) 1/7 (1)/2022- In exercise of the powers conferred by sections 3E and 4 of the Customs Act, 1969 (IV of 1969), read with section 3CCB thereof, the Federal Board of Revenue is pleased to specify the following functions, jurisdiction and powers of the Directorate-General of National Nuclear Detection Architecture (NNDA), namely: - I. Structure and layout.- The Directorate-General of NNDA shall be based at Islamabad, headed by the Director General, assisted by two Deputy Directors General one each at Islamabad and Karachi and the Director (HQ), Islamabad. The Directorate-General of NNDA shall have its regional offices at Karachi, Lahore, Peshawar and Quetta. The Director General shall report to the Chairman, Federal Board of Revenue, Islamabad. All Directorates of the Directorate- General of NNDA shall be headed by a Director and shall be assisted by Additional Directors, Deputy Directors, Assistant Directors, Supervisors, Assistant Supervisors, Radio Portal Monitor (RPM) Operators, Radio Portal Monitor (RPM) Technicians, or officers with any other designation and officials of Customs, as are required. 2. Functions and jurisdiction.- (1) The Directorate-General of NNDA shall be responsible for enforcement of all the international agreements, treaties, conventions, domestic laws, rules and procedures relating to radiation and nuclear material detection with reference to cross border movement of persons and international or bi-lateral cargo through sea, land border stations and airports and domestic laws, rules and procedures relating to inland movement of cargo and persons, through the respective Directorates. The Directorate-General of NNDA shall also supervise functioning of the Directorates, furnish policy input to the Board on matters relating to designing and implementation of the nuclear detection architecture and maintain liaison with all stakeholders. (2) In respect of the offices of the Deputy Directors-General and the Directorates of NNDA,- (a) the officers specified in column (2) of the Table below shall be the Deputy Directors General and the Directors of NNDA for the areas specified in column (3) and shall perform functions specified in corresponding column (4) thereof, namely:- Table S. Deputy Director Islamabad Capital (i) The Deputy Director General, Islamabad General NNDA, Territory (ICT), shall supervise all Customs matters relating Islamabad Provinces of Punjab to nuclear and radioactive material and Khyber- detection and allied functions of the

Pakhtunkhwa, Directorates of NNDA in his/her Gilgit-Baltistan jurisdiction; (GB) and Azad The Deputy Director General NNDA, Jammu and Islamabad shall assist the Director General Kashmir (AJ&K). in all matters relating to the policy formulation and implementation of the NNDA; and Maintain liaison with all stakeholders in the area of his/her jurisdiction at headquarters level. Deputy Director Provinces of Sindh (i) The Deputy Director General NNDA, General NNDA, and Balochistan. Karachi shall supervise all Customs matters Karachi relating to nuclear and radioactive material detection and allied functions of the Directorates in his/her jurisdiction. (H) The Deputy Director General NNDA, Karachi shall assist the Director General in all matter relating to the policy formulation and implementation of the NNDA; and (iii) Maintain liaison with all stakeholders in the area of his/her jurisdiction. Director, Directorate Islamabad Capital The Directorate shall perform overall Customs of NNDA (HQ), Territory (ICT), matters relating to nuclear and radioactive Islamabad. Civil Division material detection and allied functions in respect Rawalpindi, GB of the Directorate-General of NNDA, including and AJ&K. the original jurisdiction of the Directorate which consists of covering the following functions and Customs matters interalia: - (i) overall administration and budget related work at the Directorate-General of NNDA; overall human resource management of the Directorate-General of NNDA; establishment of Main Control Room (MCR) at Islamabad; integration of all NNDA units established across the national territory with MCR; supervision and monitoring across the national territory through the MCR, in coordination with Regional Control Rooms, established at respective Directorates of NNDA of the following cargo: - (a) all cargo imported through international entry/exit points including international airports, seaports and land border stations;

all cargo meant for exports from international entry/exit points including international airports, seaports and land border stations; all transit/TIR cargo; all transshipment cargo; all safe transportation cargo; EPZ/SEZ/Free Zones cargo; and incoming and outgoing international passengers and their luggage at all international airports; administration, budgeting and supervision of the MCR; capacity building of human resource posted at MCR and at respective RPMs; establishment of NNDA units falling under the original jurisdiction of the Directorate; supervision of personnel in NNDA units falling under the original jurisdiction of the Directorate; maintenance and upkeep of equipment such as RPM, handheld equipment etc., installed in NNDA units falling under the original jurisdiction of the Directorate; data management, monitoring of incoming and outgoing international passengers and their luggage at international airports falling under the original jurisdiction of the Directorate; coordination with all stakeholders falling under the original jurisdiction of the Directorate for operational purposes; handling of legal matters arising in consequence of detection of nuclear and radioactive material falling under the original jurisdiction of the Directorate; association in development, up-dation and enhancement of MIS functions; business process re-engineering; human resource management; trade facilitation and redressal of complaints; and any other function assigned by the Federal Board of Revenue from time to time.

4. Director, Directorate Province of Sindh The Directorate shall perform all Customs of NNDA, Karachi matters relating to nuclear and radioactive material detection and allied functions in respect of all entry/exit points including land border stations, Custom stations, seaports and airports, covering the following functions and Customs matters interalia: - establishment of NNDA units to the extent of province of Sindh; coordination with MCR at Islamabad; supervision of personnel in NNDA units established in the Province of Sindh; maintenance and upkeep of equipment such as RPM, handheld equipment etc., - installed in NNDA units in the province of Sindh; data management; monitoring of incoming and outgoing international passengers and their luggage at airports to the extent of province of Sindh; coordination with all stakeholders to the extent of province of Sindh for operational purposes; handling of legal matters arising in consequence of detection of nuclear and radioactive material in the province of Sindh; establishment and supervision of Regional Control Room; association in development, up-dation and enhancement of MIS functions; business process re-engineering; human resource management; trade facilitation and redressal of complaints; and any other function assigned by the Federal Board of Revenue from time to time. 5. Director, Directorate Province of Punjab The Directorate shall perform all Customs of NNDA, Lahore excluding Civil matters relating to nuclear and radioactive Division material detection and allied functions in respect Rawalpindi of all entry/exit points including land border stations, Custom stations and airports, covering the following functions and Customs matters interalia: -

establishment of NNDA units to the extent of province of Punjab excluding Civil Division, Rawalpindi; coordination with MCR at Islamabad; supervision of personnel in NNDA units established in the area of its jurisdiction; maintenance and upkeep of equipment such as RPM, handheld equipment etc., installed in NNDA units falling under jurisdiction of the Directorate; data management; monitoring of incoming and outgoing international passengers and their luggage at airports falling under the jurisdiction of the Directorate; coordination with all stakeholders to the extent of area of its jurisdiction for operational purposes; handling of legal matters arising in consequence of detection of nuclear and radioactive material in the province of Punjab; establishment and supervision of Regional Control Room; association in development, updation and enhancement of MIS functions; business process re-engineering; human resource management; (xi i i) trade facilitation and redressal of complaints; and (xiv) any other function assigned by the Federal Board of Revenue from time to time. 6. Director, Directorate Province of Khyber The Directorate shall perform all Customs of NNDA, Pakhtunkhwa. matters relating to nuclear and radioactive Peshawar. material detection and allied functions in respect of all entry/exit points including land border stations, Custom stations and airports, covering the following functions and Customs matters interalia: - establishment of NNDA units to the extent of province of Khyber Pakhtunkhwa; coordination with MCR at Islamabad; supervision of personnel in NNDA units established in the province of Khyber Pakhtunkhwa; maintenance and upkeep of equipment such as RPM, handheld equipment etc.,

installed in NNDA units falling under jurisdiction of the Directorate; data management; monitoring of incoming and outgoing international passengers and their luggage at airports falling under the jurisdiction of the Directorate; coordination with all stakeholders to the extent of province of Khyber Palrntunkhwa for operational purposes; handling of legal matters arising in consequence of detection of nuclear and radioactive material in the province of Khyber Palchtunkhwa; establishment and supervision of Regional Control Room; association in development, up-dation and enhancement of MIS functions; business process re-engineering; resource management trade facilitation and redressal of complaints; and any other function assigned by the Federal Board of Revenue from time to time. 7. Director, Directorate Province of The Directorate shall perform all Customs of NNDA, Quetta Balochistan, matters relating to nuclear and radioactive material detection and allied functions in respect of all entry/exit points including land border stations, Custom stations, seaport and airports, covering the following functions and Customs matters interalia: - establishment of NNDA units to the extent of province of Balochistan; coordination with MCR at Islamabad; supervision of personnel in NNDA units established in the province of Balochistan; maintenance and upkeep of equipment such as RPM, handheld equipment etc., installed in NNDA units falling under jurisdiction of the Directorate; data management; monitoring of incoming and outgoing international passengers and their luggage at airports falling under the jurisdiction of the Directorate;

coordination with all stakeholders to the extent of province of Balochistan for operational purposes; handling of legal matters arising in consequence of detection of nuclear and radioactive material in the province of Balochistan; establishment and supervision of Regional Control Room; association in development, up-dation and enhancement of MIS functions; business process re-engineering; human resource management; trade facilitation and redressal of complaints; and any other function assigned by the Federal Board of Revenue from time to time. (b) Additional Directors, Deputy Directors, Assistant Directors, Supervisors, Assistant Supervisors and RPM Operators shall be the respective officers of Customs of the areas as mentioned in column (2). 3. Powers and duties.- The concerned officers and officials of the Directorate-General of NNDA shall exercise the respective powers of the appropriate officer conferred under the Act and rules made thereunder for discharge of the functions and duties specified in this Notification.
