GOVERNMENT OF PAKISTAN MINISTRY OF COMMERCE …. Islamabad, the 5th August, 2003. ORDER S.R.O.768(I)/ 2003 .- In exercise of the powers conferred by sub-section (1) of section 3 of the Imports and Exports (Control) Act, 1950 (XXXIX of 1950) the Federal Government is pleased to direct that the following further amendments shall be made in the Import Trade and Procedures Order, 2000, namely: - In the aforesaid Order,- (1) paragraph 10 shall be omitted; (2) in paragraph 12,- (a) in sub-paragraph (2),- (i) in clause (iii), the word “and” shall be omitted; and (ii) in clause (iv), for the full stop, at the end, a semicolon and the word “;and” shall be substituted and thereafter the following new clause shall be added, namely:- “(v) any importable goods for demonstration purpose for a limited period: “ ; and (b) in the second proviso for the full stop, at the end, a colon shall be substituted and thereafter the following new proviso shall be added, namely:- “Provided also that oil exploration and production companies and construction companies working in Pakistan on various projects shall be allowed to import second hand or used specialized machinery, construction machinery and equipment as at Appendix-F-A, on import-cum-export basis, on the recommendation of the regulatory authority or sponsoring government agency, against submission of indemnity bond or bank guarantee to the custom

authorities to ensure re-export of the same after the completion of the project, on the authorization of Ministry of Commerce.”; (3) after paragraph 17, the following new paragraphs shall be inserted, namely:- “17 A Import of goods for repairing and subsequent re-export.- Import of goods into Pakistan shall be allowed irrespective of import status to engineering concerns for the purpose of repairing and subsequent re-export, subject to submission of indemnity bond or bank guarantee to the custom authorities to ensure re-export of the same within the specified period on the import authorization of Ministry of Commerce. 17 B. Import of construction machinery used abroad by the Pakistani companies.-Import of used or second hand machinery shall be allowed by Ministry of Commerce, irrespective of import status, except luxury or saloon cars or vehicles etc, as mentioned at Appendix-F-B, on completion of overseas project in favour of Pakistani companies, provided that such machinery has actually been purchased from their own foreign exchange earnings abroad, used on the foreign project and profit earned from the project repatriated to Pakistan through official channels. A certificate from the concerned Pakistan Mission confirming the actual use of such machinery on the project shall be submitted to the customs authorities at the time of import. 17 C. Clearance of importable goods sent by overseas Pakistanis without involvement of foreign exchange.- The consignee of goods in Pakistan shall be allowed to get clearance of the goods sent by overseas Pakistanis without the condition of sales tax registration. The above exemption from sales tax registration shall however, be allowed subject to the production of an earning certificate from the trade officer of the respective Pakistan Mission. In case there is no trade officer in the foreign Mission, any designated officer of the Mission may issue such a certificate.”;

(4) in APPENDIX-A, - (a) in entry I, in clause 2, in sub-clause (iii), after the word “of” the letters, hyphen, figure and comma “AISI-200,” shall be inserted; and (b) in TABLE A-1, in S.No. 32 A in column (1), for the entry in column (3), the following shall be substituted, namely: - “CFC gas based refrigerators, deep freezers and other refrigerating equipment.”; (5) in APPENDIX-C,- (a) in entry (1) in column 1, after the word “Boilers,” the brackets and words “(excluding boilers not older than five years subject to the approval by Chief Inspector of Boilers to ensure that the said boilers are fit for industrial use and are not life hazardous)” shall be inserted; (b) in entry 7 in column (1), in column (2), the figures “8424.2000, 8424.8100” and “8427.2090” shall be omitted; (c) in entry 11, in column (1) after the brackets and figure “(8710.0000)”, the comma and words “,spraying lorries or sprinklers” shall be inserted; and (d) in entry 13 in column (1), for the entry in column (2) the following shall be substituted, namely:- “90.01 to 90.08, 90.10 (excluding sub heading No.9010.1000), 90.13, 90.16, 90.17, 9018.3000 to 9018.9000, 90.19 to 90.22 (excluding sub heading No. 9022.1200), 90.25, 90.28, 90.29 and 90.32.”; (6) in APPENDIX-D, in section-I, - (a) in Sr. No. 3 in column (1), in column (4) after the word “Agency” the words “and Department of Plant Protection” shall be inserted; (b) after Sr. No. (3), and the corresponding entries relating thereto in columns (2), (3) and (4) the following new entry shall be inserted, namely;- “3A Respective All species of plants and Importable subject to Numbers. parts thereof whether living drawing of seeds samples or dead, stems, branches, and testing quality by the tubers, bulbs, corms, stock, Department of Plant bud-wood, layers, slips, Protection and the Federal

suckers, green scum on Seeds Certification stagnant pool, leaves fruits Agency .”; rhizmoes etc. (c) after Sr.No.(7), in column (1) and the corresponding entries relating thereto in column (2), (3) and (4) the following new entry shall be inserted, namely;- “7A 2804.8000 Arsenic and Importable by industrial consumers Arsenic who have valid licences issued by compounds the concerned EPAsor EPD under PEPA 1997.”; (d) in Sr.No. 9 in column (1), for the entry in column (4) the following shall be substituted, namely:- “Importable by the concerned industrial consumers who have been cleared by the Narcotics Control Division and Ministry of Health. Maximum quantities importable by an industrial unit in one year shall be determined by CBR.”; (e) in Sr. No. 17 in column (1), for the entry in column (4), the following shall be substituted, namely:- “Importable by only those pharmaceutical units having valid drugs manufacturing licence on the recommendation of Ministry of Health.”; (f) in Sr. No.25 in column (1), for the entry in column (4), the following shall be substituted, namely:- “Importable in accordance with the provisions of Agricultural Pesticides Ordinance, 1971 ( II of 1971) and the rules made there-under, as amended from time to time and those drugs which are registered under the Drugs Act, 1976(XXXI of 1976) and the rules made thereunder .”; and (g) Sr.No.33 in column (1) and the entries relating thereto in columns (2),(3) and (4) shall be omitted; and (7) after APPENDIX-F the following new appendices shall be inserted, namely:-
