Amendment in the Customs Rules, 2001

GOVERNMENT OF PAKISTAN (REVENUE DIVISION) FEDERAL BOARD OF REVENUE **** Islamabad, the 13th May, 2024. NOTIFICATION (Customs) S.R.O. 61 7 (1)/2024.- The following draft of certain further amendments in the Customs Rules, 2001, which the Federal Board of Revenue proposes to make in exercise of the powers conferred by section 219 of the Customs Act, 1969 (IV of 1969), section 50 of the Sales Tax Act, 1990, (VII of 1990), section 40 of the Federal Excise Act, 2005 and section 237 of the Income Tax Ordinance, 2001 (XLIX of 2001), is hereby published for the information of all persons likely to be affected thereby and, as required by sub-section (3A) of section 219 of the Customs Act, 1969 (IV of 1969), notice is hereby given that objections or suggestions thereon, if any, may for consideration of the Board be sent within three days of publication of the amendments in the official Gazette. Any objections or suggestions which may be received from any person, before the expiry of the aforesaid period, shall be taken into consideration by the Federal Board of Revenue, namely:- DRAFT AMENDMENTS In the aforesaid Rules, in Chapter XXI, in sub-chapter VII,- (1) in rule 482A,- in sub-rule (1), after the word "Karachi", the expression ", Peshawar or Quetta" shall be inserted; in sub-rule (2), after the word "Karachi", occurring for the first time, the expression", Peshawar or Quetta" shall be inserted; (e) in sub-rule (5), the words "or Commercial Assistant" shall be omitted and thereafter for the expression "The format of TAD is enclosed as Appendix IIIC", the expression "TAD shall be issued for vehicle, and TAD Pass for driver and cleaner. The formats of vehicle, driver and cleaner TAD and TAD Pass are enclosed as Appendix-IIIC, Appendix-IIID and Appendix- IIIE respectively" shall be inserted; (d) in sub-rule (6), the word "General", shall be omitted and after the word "Karachi", the expression ", Peshawar or Quetta" shall be inserted; (e) in sub-rule (7), after the word "TAD", occurring for the first

time, the words "for vehicle" shall be inserted and after the expression "US$ 100", the expression" , whereas, TAD Pass for drivers and cleaners of that vehicle, shall be free of cost" shall be inserted; in sub-rule (9), after the word "Afghanistan" the expression ". In exceptional cases such as illness with personal injury, accident, or damage to the vehicle, where the stay exceeds thirty days, the matter shall be sent to the relevant country for extension of the TAD document through the transportation or commercial office in the consulates or embassies of the country. Whereas, in normal cases, penalty shall be imposed for overstay" shall be inserted; (g) after sub-rule (9), amended as aforesaid, the following new sub-rule shall be inserted, namely:- "(9A) The routes agreed in APTTA 2010 shall be followed by transport operators. The transport operators registered for bilateral trade shall not be allowed movement to seaports and crossing points with third countries;"; in sub-rule (10), after the word "Karachi" the expression ", Peshawar or Quetta" shall be inserted; in sub-rule (15), after the word "record", the expression After entering the home country, the owner shall apply for a new TAD by providing the documents that allowed him to cross the crossing points and a copy of the FIR lodged with the police" shall be added; in sub-rule (16), after the word "goods" the words "and vehicle" shall be inserted; in sub-rule (19),- in clause (c), after the word "owner" the words "or TazIcera" shall be inserted; in clause (g), the word "and", occurring at the end shall be omitted; in clause (h), for the full stop at the end, a semi colon shall be substituted and thereafter following new clauses shall be added, namely:- "(i) picture of driver; and (j) picture of cleaner."; (I) after sub-rule (19), amended as aforesaid, the following new sub-rule shall be inserted, namely:- "(19A) Transport operators which are engaged in bilateral trade shall get themselves registered with the Directorate of Transit Trade, Peshawar or Quetta to avail the

TAD facility subject to fulfillment of following requirements, namely:- An application for registration as per Appendix- IIIF; Attested copy of CNIC of the owner of the vehicle; Attested copy of registration book of the vehicle; A valid fitness certificate for the vehicle; and Undertaking on a stamp paper by the owner of the vehicle to the effect that he shall be responsible for safe transportation of export or import goods."; in Appendix-HIA, after the word "Passport", the words "or Tazkera" shall be added and after the word "goods", occurring for the second time, the words "and vehicle" shall be inserted; and for Appendix-HIC, the following new Appendices shall be substituted, namely:- "Appendix-HIC [see rule 482A(5)] Logo of Country Name of Authorized Authority TEMPORARY ADMISSION DOCUMENT: VEHICLE LOG BOOK VEHICLE REGISTRATION NUMBER: TAD No. Date of Issue Valid up to Details of Vehicle Details of Transport Operator Make/Manufacturer Name of company Model Year License Number Colour RegistrationContact & Cell No. NumberAddress Engine Number Chassis/Frame Number Picture of Vehicle: Front Picture of Vehicle: Back View Number Plate View Number Plate •

Name and Designation of Signature Stamp Authorized Officer Instructions: I. This document shall be kept in the vehicle and in possession of authorized driver at all times. This TAD is non-transferable to any other vehicle. The driver and cleaner detailed on this vehicle shall have TAD-Pass. All entries shall be made in the Log Table overleaf and shall be authenticated by Authorized officer. This form is valid for multiple journeys with maximum 30 days for each journey. The driver's biometric (10 fingers) shall be captured by the authorities at the crossing point for ONLY ONE TIME. Further entry/exit shall be allowed through one thumb scan at the crossing point.
